Non-litigation collection cases:
1. Triangular debt case: The client, Dongguan Mingxi Valve Company, had a debt of over 1.2 million yuan from Tianjin Baiyi Equipment Company that had not been recovered for a long time. After taking over the case, our lawyer team found that the debtor, Tianjin Baiyi Equipment Company, had two receivables totaling 1.3 million yuan from China Construction and China Construction Installation Group. After applying pressure and negotiating with multiple parties, the debtor agreed to transfer its receivables from the above-mentioned China Construction companies to the creditor, Dongguan Mingxi Valve Company. In the end, the case was settled through non-litigation collection without going through a lengthy litigation process.
2. Historical debt case: The client, Guangdong Changyi Electric Company, undertook the distribution box and bus duct project of Sofitel Guangzhou in 2010. After receiving the payment from the owner, the general contractor refused to pay the client's project payment and deliberately evaded the debt for eight years. After taking over the case, our lawyer team applied pressure to the owner through the retention of title clause, and the owner then pressured the debtor, eventually achieving full repayment.
3. Quality guarantee deposit case: The client, Guangdong Chuangming Sunshade Company, undertook the sunshade project of Guilin Dada Square in 2016. After the project was completed and accepted, Guilin Dada Square paid the progress payment as agreed, but the remaining quality guarantee deposit was delayed for six years due to personnel changes. After taking over the case, our lawyer team followed the clues, actively negotiated with the engineering department, commercial management department, and property management unit, and finally achieved full repayment without litigation.
4. Difficult enforcement case: The client, Guangdong Yiyi Electric Company, had a dispute over a sales contract with Linyi Solar Energy Co., Ltd., involving an amount of over 139 million yuan. After a judgment by Foshan Intermediate People's Court and application for compulsory enforcement, the case was terminated due to the lack of valuable assets of the debtor. After taking over the case, our lawyer team investigated and found that the debtor's affiliated company had won a government project in Linyi, Shandong. Using this as a pressure point, they negotiated with the debtor, analyzed the pros and cons, and finally reached a settlement and recovered the payment.
Civil litigation and criminal defense cases: Subrogation case:
1. Our law firm was entrusted by Guangdong Mingxiang Electric Co., Ltd. to file a lawsuit against Shandong Guoyuan Construction Group for the recovery of over 5 million yuan in unpaid goods. After the judgment took effect, the execution was unsuccessful. The construction group was repeatedly listed as a dishonest entity and had outstanding debts of over 300 million yuan, effectively on the verge of bankruptcy. After investigation and analysis, our team discovered that the debtor had an outstanding receivable of nearly 8 million yuan from Shanxi Coal Group. We then exerted pressure on the debtor through negotiations, compelling them to transfer this high-quality receivable to the client's name. We immediately filed a lawsuit against the secondary debtor, Shanxi Coal Group, and ultimately helped the client successfully recover the 5 million yuan in goods.
2. A 130 million yuan private lending case: The parties involved are a Chinese-American and a Hong Kong resident of China. The guarantors are a pawnshop company and an asset management company. This was a smokeless but extremely complex battle, and the client won the first instance in full! The case involved 130 million yuan - private lending - foreign-related disputes - separate filings - certification by the US Secretary of State - entrusted notarization - English translation - jurisdictional objections - 8 court hearings - foreign-related evidence - disputes over the cause of action - entrusted collection and payment - account clarification - exclusion of irrelevant funds - company guarantee - joint and several guarantee - guarantee period - overpayment of interest - 4 times LPR, etc.
3. Electronic commercial bill dispute case: The client held 3 electronic commercial acceptance bills with a total amount of 720,000 yuan. The bank refused to accept them on the grounds that the paying unit refused to pay. Our law firm guided the client step by step to click on the request for payment in the electronic bill system in a timely manner and to click on the recourse to all previous parties. At the same time, we sent the "Notice of Exercise of Recourse Rights" to the drawer and endorser offline. After all the evidence in this case was complete, we immediately filed a lawsuit against the drawer and endorser and simultaneously applied for property preservation.
